POWERS AND RIGHTS TO NAME TOWN PROPERTY OR FACILITIES.
The procedures set forth herein shall be utilized by the Town of Belleair Commissioners in the naming of public property or facilities and said decision of the Town of Belleair Commissioners is hereby declared to be an exercise of the legislative power of the town. The Town of Belleair Commissioners retains the right to rename or redesignate any town property or facilities named under the procedures set forth herein and it is hereby declared that there is no property right conferred upon any individual, group of individuals or organization arising from the naming or other designation of any town property or facilities.
ELIGIBLE PROPERTY FOR NAMING.
Any town property or town facility not already carrying a formal name may be proposed for consideration by any of the persons or groups set forth hereinafter. A town property or town facility presently carrying a formal name may be proposed for renaming by the Mayor or a Town Commissioner.
PARTIES ALLOWED TO PROPOSE NAMES.
A name for the town property or town facility may be proposed for consideration by any one or more of the following, to wit:

(A) A resident of the Town of Belleair with the concurrence that such proposal be considered by not less than three members of the Town of Belleair Commissioners; or
(B) A non-profit, chartered and town-based organization; or
(C) A town appointed board; or
(D) The Mayor or a Town Commissioner.
REGULATIONS FOR SELECTING NAME.
A proposed name may not be:
A living person, except as a condition of a significant monetary contribution as determined by a majority vote of the Town of Belleair Commissioners. A family name with living members is acceptable and is not precluded by this criteria.
(B) A name originating from or representing a religion.
(C) False, misleading, or deceptive.
(D) Relating to an illegal activity.
(E) Relating to explicit sexual material, obscene material, or material harmful to minors.
(F) Advertising Tobacco products.
(G) Language which is obscene, vulgar, profane, or scatological.
(H) Depicting violence and/or anti-social behavior.
(I) Relating to instruments, devices, items, products or paraphernalia that are designed for use in connection with specific sexual activities.
GUIDELINES AND CRITERIA FOR PROPOSED NAME.
The guidelines and criteria for consideration of a proposed name are as follows:
(A) The sponsor of the proposed name shall provide written documentation to the Town of Belleair Commissioners addressing each of the points set forth hereinunder, if applicable. Guidance and assistance may be sought by the sponsor from the Administration Department, as appropriate. The information required to be provided is as follows:
(1) Identification, description and location of the town facility, town property or area within the town's jurisdiction to be named.

(2) Verification, to the degree possible, that the facility, property or area has not been previously named. In the instance where a property, facility or area already carries a name and there is no written evidence of the name's origin, an inquiry shall be made to the Planning and Zoning Board to determine whether the commonly used name is historically significant, and as such, the facility, property, or area shall be considered as having previously been formally named.
(3) A description of the meaningful connection, association or relationship between the proposed name and the facility, property or area. The suitability of the name with respect to the facility, property or area must be established. Examples of associations involving a person's name that would be satisfactory would be discoverer, pioneer, donor, benefactor, previous or original land owner, user or organizer. Acceptable examples of associations involving animal or object names are those which are indigenous or a specific animal or object of historical importance but not necessarily indigenous. A lofty or inspirational ideal or precept may be suitable if a recognized meaningful connection is able to be established in tangible terms.
(4) If a person's name, a description of the person's meritorious accomplishments or service for the good of the community. Quality of contribution may be considered along with the length of service by the individual. All matters involving this criteria must be fully substantiated.
(B) All proposed names, particularly for new streets and thoroughfares, other than those included in a development order, must be reviewed by the Building Department to ensure that the name does not duplicate or conflict phonetically with existing street names, regardless of their designation of street, avenue, drive, place or other designation.
(C) The applicant, with the assistance of the Administration Department, as appropriate, must conduct a background search of the name, whether person, animal, object or ideal for identifying anything significant or relevant that may be construed as offensive to any segment of the community.
(D) Such additional criteria as the Town of Belleair Commissioners may request upon consideration of the proposal.
NOTICE OF NAME CONSIDERATION.

Prior to consideration of the Town of Belleair Commissioners of an ordinance naming a facility, property or area, the Administration Department will notify all property owners within 200 feet of the facility, property or area proposed to be named and such notice will include the date of the public meeting at which such matter will be discussed or the ordinance will be given consideration. The facility, property or area proposed to be named will be posted with a notice reflecting the consideration of the proposed name and date of the meeting at which such proposal will be considered by the Town of Belleair Commissioners.
NAME MUST BE ADOPTED BY ORDINANCE.
The naming of a facility, property or area will be accomplished by the adoption of an ordinance. The normal notification requirements for ordinance adoption will be followed. In the event that any facility, property or area presently carrying a name is proposed to be renamed, the same procedure will be followed.
INTENT.
It is intended by the Town of Belleair Commissioners that careful and serious consideration be given to the naming of any town facility, property or area. Such deliberative consideration is appropriate to ensure that the proposed name deserves the honor of public recognition. As a "rule of thumb" for determining whether a proposed name is deserving for public recognition, similar existing "name and property" combinations now present within the community may be compared to the proposal as a means of determining equivalency and appropriateness.
