RESOLUTION NO. 499616
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY ESTABLISHING POLICIES AND PROCEDURES FOR THE NAMING AND RE-NAMING OF PUBLIC STREETS, PATHS, AND THOROUGHFARES
WHEREAS, the City of Union City ("City") has maintained policies, objectives and principles for the naming (Resolution No. 1137-70) and re-naming (Resolution No. 3336-07) of City parks and recreation facilities; and
WHEREAS, these policies have resulted in a fair process for the naming and re-naming of such facilities for over 46 years (naming) and 9 years (re-naming), respectively; and
WHEREAS, the naming of City streets, paths and thoroughfares have not been governed by any written policies, and have been created by a combination of developer applications (associated with new development projects) and informal City Council policies (naming streets for elected and appointed officials in the City of Union City); and
WHEREAS, the foundational policy governing the naming of public facilities in the City of Union City has been that, once named for a real person, living or deceased, a facility name shall be kept in perpetuity; and
WHEREAS, certain property owners and residents living on a street named for a City Councilperson have requested an opportunity to petition the City for a change in of said street, making it appropriate to establish uniform policies and procedures for re-naming streets.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Union City that the following policies and procedures for the naming of public streets, paths, and thoroughfares, is hereby adopted and established for the guidance and direction of the City Council and all other officials, individuals, and bodies of the City concerned with the subjects herein contained.
POLICIES
1. The City Council shall exercise final authority in the naming of all public streets, paths, and thoroughfares.
2. The name of a street, once selected, is intended to be permanent and cannot be changed without the full vote of the City Council.
3. Once a City street, path, or thoroughfare is named for a real person, living or deceased, said name shall be kept in perpetuity.
4. Absent an amendment of this policy, the City Council shall adhere to the policies, objectives and procedures specified herein.
OBJECTIVES
1. To establish a uniform procedure for the naming and re-naming of City streets, paths, and thoroughfares which reflect the City's diversity, history, and general community compatibility.
2. To name streets, paths and thoroughfares so they will be easily identified and compliment the area in which they are located.

PROCEDURES - NAMING NEW STREETS
1. Whenever a new street, path, or thoroughfare is developed, a proposed name shall be forwarded to City staff in one of the following two ways:
a. A developer shall forward the proposed street name(s) to the City Manager for any public or private streets constructed in conjunction with the new development; or
b. City staff shall develop proposed street name(s) in accordance with established City Council policies.
2. The City Manager shall review the proposed new street name(s) for general compliance with established City Council street naming policies, and may propose alternate name(s), if necessary.
3. Once review is completed, the City Manager shall forward the proposed street name(s) to the City Council for approval; the City Council may adopt or modify the proposed street name(s) as it sees fit, subject to existing City Council policies.
4. The decision of the City Council is final.
PROCEDURES - RE-NAMING STREETS
1. Whenever a group of property owners who own property in the City of Union City on an existing street wish to seek City Council approval for re-naming said public street, a petition may be submitted to the City Clerk requesting the re-naming of said street and proposing a new street name. The petition shall also state the justification for re-naming the street in question.
2. The petition must be signed by 75% (or more) of the property owners who own property along the existing street.
3. The City Clerk shall review the submitted petition and validate the signatures contained therein; and invalid signatures shall be stricken and shall not count toward the 75% minimum petition threshold.
4. If any petition contains fewer than 75% of eligible property owners' signatures, said petition shall be disqualified.
5. Once validated by the City Clerk, the petition shall be forwarded to the City Manager, who shall review the petition for general compliance with established City Council policies, and forward the petition, along with staff recommendations, to the City Council.
6. The City Council may adopt the proposed street name(s) as it sees fit, subject to existing City Council policies.
7. The decision of the City Council is final.
Community Park: These parks are generally developed to serve the community composed of several neighborhoods. They are generally located adjacent to an intermediate or high school and should be named to compliment or preserve the natural character or features of the community, historical heritage of the community, appreciation of nature, great causes, and historical events. The ethnic character of a community shall not be used in the name since the ethnic balance of communities is seldom stable.

Area Parks: These parks are generally located in a remote area away from the neighborhoods and any residential area. These parks shall be named after horticulture and wildlife, waterways, or natural phenomena.
4. The name of a park or facility, once selected, is intended to be permanent and cannot be changed without the full vote of the City Council.
The foregoing resolution was introduced at the regular meeting of the City Council on January 19, 1970, by Councilman Garcia who moved its adoption and passage, which motion was carried after being duly seconded and passed by the following vote:
